Mediation is completely confidential, so spouses can rest assured that they will be able to discuss issues openly and frankly without anything they say being used against them in court. While Attorney Swearingen will act as an advisor, informing spouses about the law and their legal requirements and obligations, the actual decisions about how to resolve the issues will be made by the spouses themselves. These decisions will only be legally binding after both spouses have agreed to them and they are entered into their divorce decree.

The mediation process can be derailed by spouses who are unwilling to budge on certain issues, who are trying to inflict damage on their former partner, or who are attempting to hide information or assets. If one or both spouses are unwilling to work together, they will likely be unable to reach a resolution to their divorce through mediation.
